1. Acceptance of Terms
Welcome to Sitelas, a service provided by Code Axiom ("we," "our," or "us"). By accessing or using our AI-powered website builder platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after any changes constitutes acceptance of the new Terms.
2. Description of Service
Sitelas is an AI-powered website builder platform that allows users to:
- Create and host professional websites using AI
- Choose from professionally designed templates for various use cases
- Customize content, design, and layout using our AI-powered editor
- Receive a subdomain (yourname.sitelas.com)
- Access analytics, contact forms, and other built-in features
- Connect custom domains (optional)
3. Account Registration
3.1 Eligibility
You must be at least 16 years old to use our service. By registering, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account access.
3.3 Sites and Per-Site Subscriptions
You may create unlimited free sites on Sitelas subdomains. Each site carries its own subscription tier — Free by default, with an optional Pro upgrade per site described in Section 4. There is no cap on sites per account.
4. Sitelas Plans and Subscriptions
4.1 Plans
Sitelas offers the following tiers, applied per site:
- Free — Unlimited sites on Sitelas subdomains, full visual builder, $5 AI credits on signup. Operational caps apply (see our pricing page); custom domains and integration primitives require Pro.
- Pro — $9/month per site. Adds custom domain with auto SSL, removes Sitelas branding, higher operational caps, full analytics, and branded email.
- Enterprise — Custom pricing for agencies and multi-location businesses. Contact contact@sitelas.com for details.
All prices are in USD.
4.2 Per-Site Billing
Each site carries its own subscription, tied to its subdomain. You may hold multiple sites on different tiers under one account. The Free tier is the evaluation path — no time-limited trial applies, and no credit card is required to use it.
4.3 AI Credits
AI generation and chat features are metered by a credit balance, billed separately from site subscriptions. New accounts receive $5 in free credits on signup. Additional credits are available as pay-as-you-go top-ups ($5, $10, or $25) via Stripe one-time payment.
4.4 Billing and Payment
Subscription payments are processed through Stripe on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on that recurring basis. You are responsible for keeping your payment information current.
4.5 Cancellation and Downgrade
You may cancel a paid site subscription at any time from your dashboard. Upon cancellation:
- Paid features remain active through the end of the current billing period.
- At the end of the billing period, the site downgrades to Free and remains published with Free-tier operational caps.
- No refunds are issued for unused days in a billing period, except where required by law.
4.6 Failed Payments
If a scheduled payment fails, paid features remain active for a three-day grace period during which we retry the charge and notify you. If the payment cannot be collected within that window, the site automatically downgrades to Free.
4.7 Refunds
Because the Free tier offers genuine operational access for evaluation, we do not offer refunds on paid subscriptions as a general policy. Exceptional circumstances may be considered at our discretion.
4.8 Price Changes
We reserve the right to change subscription pricing with at least 30 days' notice. Existing subscribers are honored at their current rate through the end of their prepaid period; renewals use the new rate.
5. User Content
5.1 Ownership
You retain ownership of all content you create and upload to your website, including text, images, and other materials ("User Content"). By using our service, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of providing our service.
5.2 Content Responsibility
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to use and share all content on your website.
- Your content does not infringe on any third party's intellectual property rights.
- Your content is accurate and not misleading.
5.3 Prohibited Content
You agree not to post content that:
- Is illegal, harmful, threatening, abusive, or harassing
- Contains sexually explicit material, hate speech, or discrimination
- Infringes on intellectual property rights
- Contains malware, viruses, or malicious code
- Is spam or deceptive in nature
- Violates any applicable laws or regulations
- Impersonates another person or entity
5.4 Content Moderation
We reserve the right to review, remove, or disable access to any content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.
6. Subdomains and Custom Domains
6.1 Subdomain Allocation
You may select an available subdomain (e.g., yourname.sitelas.com) for your website. Subdomain allocation is on a first-come, first-served basis.
6.2 Subdomain Restrictions
We reserve the right to refuse, reclaim, or reassign subdomains that:
- Infringe on trademarks or brand names
- Are offensive, misleading, or inappropriate
- Are associated with terminated accounts
- Violate our policies
6.3 Custom Domains
You may connect your own custom domain to your website. You are responsible for domain registration, DNS configuration, and any associated costs with your domain registrar.
7. Intellectual Property
7.1 Our Intellectual Property
Sitelas, including our templates, design, code, logos, and other materials, are owned by Code Axiom and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our express written permission.
7.2 Template License
Your subscription grants you a limited, non-exclusive, non-transferable license to use our templates for your website while your subscription is active. This license does not include the right to resell, redistribute, or use templates for purposes other than your own websites.
8. Service Availability
We strive to maintain 99.9% uptime for our service. However, we do not guarantee uninterrupted access and are not liable for any downtime, whether scheduled or unscheduled. We may modify, suspend, or discontinue any aspect of the service at any time.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITELAS AND CODE AXIOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the service will be error-free, uninterrupted, or secure, or that any defects will be corrected.
11. Indemnification
You agree to indemnify, defend, and hold harmless Code Axiom and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
12. Termination
We may suspend or terminate your account and access to the service at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of subscription fees
- At your request
Upon termination, your website will be unpublished. We may retain certain data as required by law or for legitimate business purposes.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.
14. Dispute Resolution
Before filing any formal legal claim, you agree to contact us first to attempt to resolve the dispute informally. Most concerns can be resolved quickly and to your satisfaction by emailing contact@sitelas.com.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Code Axiom regarding your use of Sitelas and supersede any prior agreements.
